Bowie, Dave Matthews Band Rescue Royalties

David Bowie, the Dave Matthews Band, Sean “P. Diddy” Combs, Dolly Parton and John Mellencamp are just a few of the thousands of artists who will receive payments from the major labels for unclaimed, unpaid royalties.

The $50 million payout was the result of a deal struck by New York State Attorney General Eliot Spitzer, who negotiated with Sony Music Entertainment, Sony ATV Music Publishing, the Warner Music Group, UMG Recordings,Universal Music, EMI Music Publishing, EMI Music North America, BMG Songs, Careers-BMG Music Publishing, BMG and the Harry Fox Agency.

The deal caps a two-year investigation sparked by music industry attorney Bob Donnelly, who brought the issue of labels failing to keep contact with performers and making proper royalty payments. More than $25 million has been paid out so far, with another $25 still expected to be distributed.

As part of the deal, the labels and publishers also agreed to list the names of artists and writers who are owed monies, post the procedure to claim outstanding royalties in various music industry publications, share contact information for artists with other labels and work with various industry groups and unions to locate artists. The companies also pledged that their royalty and accounting departments would work towards improving their payment procedures and that they would abide by the state’s Abandoned Property Law. If an artist or his or her family cannot be located for payment, those royalties are to be paid to the state, which holds them until a claim is made.

For some, the payout amounts to a drop in the bucket. The Dave Matthews Band is owed just over $14,000 (its 1996 album, Crash, for instance earned $4,000 that wasn’t properly paid), while the $10,700 that Bowie was owed was just for 1997’s Earthling. And for other artists, the payout comes too late, as deceased artists including Jim Croce, Waylon Jennings, Dizzy Gillespie and Frank Sinatra were all owed sums. But the estates of deceased musicians received some of the larger payouts, including that of songwriter Tommy Edward, which is due almost $230,000.

The investigation also found that outstanding royalties were also due to artists who didn’t necessarily make vast sums of money, and the likes of Texas singer-songwriter Guy Clark or avant garde jazz pianist Cecil Taylor might benefit from the windfall of a few thousand dollars. “[Some] artists struggle,” Spitzer said at a press conference announcing the deal in New York City today. “They depend on the stream of royalties.”

Spitzer praised the record companies for their willingness to reach the agreement and suggested that the unpaid monies were an oversight. “It’s not like there was a grand conspiracy to cheat them out of these big sums of money,” he said. “It was just a failure to do what should have been done. That’s why we have this settlement.”

Spitzer is no stranger to investigating the business practices of the major labels. In August 2000, he led a charge against the five major labels charging them with conspiring to fix the prices of CDs. New York and Florida were at the front of a lawsuit filed by twenty-eight states that resulted in another settlement.

Beta Band Single Due Out June 28th On CD And Vinyl

The Beta Band will release their new single “Out-side” on June 28. The track is the second to be lifted from their latest album Heroes To Zeros and will come out on CD and vinyl.

The video for “Out-Side” is to be written and directed by the band and according to drummer Robin Jones it will be “a remake of ‘The Carnival Of The Animals’ starring humans instead of animals.”

Details of B-sides are yet to be confirmed.

Radiohead, Record Crowds Mark Coachella Fest

A record 50,000 fans turned out on Saturday and Sunday for the fifth Coachella Valley Music & Arts Festival in Indio, Calif., headlined on respective days by Radiohead and the Cure. The event also featured the first festival appearance by the reunited Pixies and a sensational Saturday-closing set by pioneering German electronic/rock act Kraftwerk.

Despite a throat problem that forced frontman Thom Yorke and his Radiohead bandmates to cancel a show earlier in the week in Australia, the band was in fine form during its 20-song Saturday set. Six songs from its latest album, “Hail to the Thief,” were sandwiched in between such favorites as “Creep,” “Paranoid Android,” “My Iron Lung” and the rarity “Planet Telex.” Coachella is expected to be Radiohead’s only North American gig of 2004.

The Cure unveiled several tracks from its upcoming self-titled release, due June 29 via Geffen, including new single “End of the World” and album opener “Lost.” The group dipped into its extensive back catalog for such tracks as “Fascination Street,” “Just Like Heaven” and “Love Song.”

The Pixies’ early evening set on Saturday lived up to all the hype, as the quartet ripped through tracks like “Gouge Away,” “U-Mass,” “Debaser” and the sing-a-long “Here Comes Your Man.” Kraftwerk conjured a visual bonanza later in the evening, climaxing with its four members decked out in glowing neon suits for “Music Non Stop.”

Other events of note included the first live appearance of Desert Sessions, led by Queens Of The Stone Age’s Josh Homme; a guest appearance by the B-52s’ Fred Schneider during Junior Senior’s Saturday performance; a guest trumpet solo by the Red Hot Chili Peppers’ Flea during the Evens’ set on Saturday; and the finale of Basement Jaxx’s Sunday set, which found three singers and five costumed gorillas leading the crowd through “Where’s Your Head At?”

The larger crowd contributed to performance tents that were more crowded than at any previous Coachella, most noticeably during Beck’s solo acoustic set on Saturday. But organizers deemed the fest a success, proclaiming on Saturday, “Today was truly magical.”

Phish Album And Bonus DVD Due June 15th

Undermind, Phish’s first studio album since 2002’s Round Room, is due in stores June 15th on Elektra Records. The album was recorded at the Barn in Vermont and mixed at Real World Studios in England by producer Tchad Blake (Tom Waits, Los Lobos, Soul Coughing, Peter Gabriel). Of the fourteen new tracks, many have never been performed live, including “A Song I Heard the Ocean Sing”, “The Connection” (the album’s first single), “Nothing”, “Access Me”, and “Tomorrow’s Song”. “Army of One”, a familiar solo number at Vida Blue and Phish shows, gets a full band treatment here, and “Secret Smile” features string arrangements by noted composer/arranger Maria Schneider.

The first pressing of the album will include a special bonus DVD of the 26 minute short film Specimens of Beauty, directed by longtime Phish photographer Danny Clinch, that chronicles the recording of the album in Vermont.
